BREEDING CONTRACT
This Stallion Breeding Contract for the 2009 Breeding Season is made and entered into on this day of 2009, by
and between Jackie Nelson, Breeder and ______________________________________________hereinafter
designated Mare Owner. Mare Owner agrees to breed to mare_____________________________
Registration No._______________________________ to the Stallion, Sonnys Mister Trubar, APHA
Registration No.719,201- Pinto Registration No. 117851, for the fee of $750.00 if booked before December
31st of 2008. Stud fee is $950.00 from January 1st 2009 subject to the following conditions:
1. The Stallion fee includes a non-refundable booking fee of $250.00, payable upon execution of this
contract. The balance of this fee must be paid, with all other expenses incurred, including all vet work when
mare is picked up.
2. Mare Owner agrees to pay for care and feed at $15.00 per day for dry Mares
and $20.00 per day for wet Mares.
3. Breeder agrees to diligently try to settle mare, however, if mare fails to settle, for any reason, Mare
Owner agrees to hold Breeder blameless. Mare Owner agrees to give Breeder ample opportunity to settle Mare.
4. This contract contains a Live Colored Foal Guarantee. A live foal is described as a newborn foal which
stands and nurses without assistance. If foal is born dead, there are return privileges for the 2009 season only
if Breeder is notified within 15 days. If after being pronounced “safe in foal”, the Mare should miscarry, abort, or
prove barren after leaving the Breeders premises, the Mare owner has the privilege to return her for breeding
during the current breeding season 2009 through 6/15/09, or the following breeding year 2010.
5. Both Parties agree that Down Under Colour, the Breeder, is not liable for death, sickness, and/or
accident including damages caused to Mare and/or Foal unless caused by gross negligence of the Breeder
and the Mare Owner is not liable for death, sickness, and/or accident to the Stallion.
6. It is further agreed that should the Stallion die, be sold by the owner, or become unfit for service, prior
to breeding the Mare, that $500.00 of the breeding fee IF paid in full before Jan 1st 2009 or $700 after Jan 1st
2009) will be refunded, IF it has been paid in full, thereby canceling this contract. Or if the Mare dies or
becomes unfit to breed, the Breeder has the option to either accept another Mare or refund $500.00 IF paid in
full before Jan 1st 2009 or $700 IF paid in full after Jan 1st 2009 of the breeding fee, IF it has been paid in full,
thereby canceling this contract.
7. All mares must be cultured and have a clean culture result from a licensed veterinarian prior to exposure
to stallion.
When Mare Owner and Breeder, or Breeders Agent sign this contract, it will then be binding by both parties,
subject to the above terms and conditions.
Please send one copy of this contract to Down Under Colour and keep one for yourself. Also enclosed with this
contract must be : Booking Fee of $250.00. Copy of Mares registration papers,negative culture and negative
coggins results and vaccination records.
